Terms of Use
These Terms of Use (“Terms”) govern your use of the mobile apps, websites, and related services operated by Pas à Pas Studio LLC (“Pas à Pas Studio”, “we”, “us”), together the “Services”. By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
An individual app may include additional terms. If it does, those terms apply together with these, and they control if the two conflict.
Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian who agrees to these Terms.
License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services on devices you own or control, for your own non-commercial purposes. If you obtained an app through the Apple App Store or Google Play, your use is also subject to that store’s usage rules.
You may not:
- copy, modify, distribute, sell, or lease any part of the Services;
- reverse engineer or attempt to extract source code, except where the law expressly permits it;
- interfere with or disrupt the Services, or bypass any security or usage limits;
- use the Services for anything unlawful, harmful, or that infringes the rights of others.
Accounts
If an app offers accounts, you are responsible for keeping your credentials secure and for activity under your account. Tell us promptly if you suspect unauthorized use. You may delete your account at any time.
Your content
You keep ownership of content you create or upload in the Services. You grant us a limited license to host, store, and process that content only as needed to operate the Services for you. You are responsible for your content and confirm you have the rights to it.
Purchases and subscriptions
Some features may require a one-time purchase or a subscription. Purchases are processed by Apple or Google and are subject to their terms, including their refund policies. We do not process payments or issue refunds directly.
Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before renewal. You can manage or cancel subscriptions in your App Store or Google Play account settings. Deleting an app does not cancel a subscription. Prices may change; any change will take effect at your next renewal after notice.
Intellectual property
The Services, including their software, design, text, graphics, and trademarks, are owned by Pas à Pas Studio or its licensors and are protected by law. Except for the license above, these Terms grant you no rights in them.
If you send us feedback or suggestions, we may use them freely without obligation to you.
Third-party services
The Services may link to or rely on services provided by others. We are not responsible for third-party services, and your use of them is governed by their own terms.
Privacy
Our Privacy Policy explains how we handle your information.
Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or that data will never be lost. Keep your own backups of anything important.
Limitation of liability
To the fullest extent permitted by law, Pas à Pas Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the Services in the 12 months before the claim, or US$50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits rights you have as a consumer that cannot be waived by contract.
Indemnity
You agree to indemnify and hold Pas à Pas Studio harmless from claims arising from your misuse of the Services or your violation of these Terms.
Termination
You may stop using the Services at any time. We may suspend or end your access if you violate these Terms or if we discontinue a Service. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.
Apple App Store terms
If you downloaded an app from the Apple App Store, you acknowledge that these Terms are between you and Pas à Pas Studio only, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for addressing any claims relating to the app, including product liability, legal compliance, or intellectual property claims. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction. If you are a consumer in the EU or UK, you also benefit from the mandatory protections of the law of your country of residence and may bring claims in your local courts.
Changes
We may update these Terms from time to time. We will post the new version on this page and update the effective date. If changes are material, we will give additional notice, such as in the app. Continuing to use the Services after changes take effect means you accept them.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms are the entire agreement between you and us regarding the Services.
